As a reminder, we’ve created a Realignment Bookshop affiliate store showcasing books by guests, what we’re actively reading this year, and deeper dives into the featured topic of an episode.
If you purchase a book using our link, the show gets a 10% commission, a local, independent bookseller gets support, and you get an awesome book!
We’re reorganizing our book lists over the next few weeks, so for now, check out our primary one:

Marshall you are so much more enjoyable to listen to then Saagar is. Wish you had your own channel! Keep rocking youre such an amazing interviewer and your wide knowledge really shows.
There is an excellent analog for red flag laws: the temporary restraining order. It starts as a pro se (one party) petition for a judge to make a finding concerning the likelihood of immediate future harm. The judge has the authority to limit the freedom of a party before that party is even aware of the accusation.
But, the judges authority is extremely time limited. There must be a full adverbial hearing (with notice and opportunity to be heard for both sides) for the judge to take longer term action.
The judge can limit a person’s freedom of movement and bo association (both protected under the 1st amendment)
My analogy is limited, though because the remedy is forward looking. In the context of gun control, I can’t imagine the risk of violence that would inherently follow any order to CONFISCATE a firearm from a person because that person is unstable.
